Ex-BGH-Richter gegen Absprachen zur Strafminderung

In einem Gastbeitrag für die Frankfurter Allgemeine Zeitung (F.A.Z./Mittwochsausgabe) lehnt Wolfgang Neskovic, ehemaliger Richter am Bundesgerichtshof und heute Justitiar der Bundestagsfraktion Die Linke, Absprachen in Strafprozessen ab, die zu einem Strafnachlass führen. Das Bundesverfassungsgericht verhandelt an diesem Mittwoch über die Zulässigkeit solcher Absprachen. Neskovic lehnt solche Absprachen, die seit 2009 kodifiziert sind, ab, da sie gegen das Kernprinzip des Rechtsstaats verstoßen, dass vor dem Gesetz alle Menschen gleich seien, schreibt Neskovic in dem Beitrag für die F.A.Z. Die Justiz sei jedoch wegen Überlastung an solchen Absprachen interessiert, aber nicht mit derselben Neigung gegenüber jedem Täter.

Ein Anlagebetrüger könne eher mit einem solchen "Deal" rechnen als einer, der wegen eines einfachen Diebstahls angeklagt sei. Das führe jedoch zu einer Klassenjustiz, schreibt Neskovic. Je vermögender der Angeklagte sei, desto komplexer sei das Delikt und umso mühseliger dessen Aufklärung. Bei solchen Deals verliere der Staat seine Glaubwürdigkeit und seinen gesellschaftlichen Zusammenhalt.
